Harman facing court for crash while on mobile

HARRIET Harman is to face prosecution after allegedly crashing her car while on a mobile phone.
Witnesses claimed that although Labour’s deputy leader stopped briefly after hitting the parked vehicle, she drove off without leaving details of her insurance company or her car’s registration.
But she will only be prosecuted for the driving offences, rather than leaving the scene, which could have left her with a possible six-month jail term.
When approached, she is alleged to have told a witness: ‘I’m Harriet Harman… you know where you can get hold of me.’ The 59-year-old is said to have struck the car in her constituency of Peckham, south east London, in July.

Earlier this month Miss Harman, who is also Leader of the Commons, was questioned by police about the incident and a file was sent to the Crown Prosecution Service. Yesterday the CPS announced there was enough evidence to prosecute her.
She will be summoned to court by police, a method of bringing someone before a court without formally charging them. She is accused of driving without due care and attention and using a hand-held mobile telephone.
Miss Harman, a former Solicitor General, could face a fine of [pounds sterling]6,000 and up to 12 points on her licence if found guilty of the driving offences, which she strongly denies. Magistrates could also ban her from driving.
The married mother of three already has three points on her licence for speeding in 2007.
The incident is a major embarrassment for Labour Party, which brought in the law to punish motorists holding a phone while behind the wheel in 2003.
Prosecutors and road safety campaigners have argued in the past that those found guilty of the offence should be jailed.
Yesterday the CPS issued a statement saying: ‘The Crown Prosecution Service has decided there is sufficient evidence and it is in the public interest to prosecute the Rt Hon Harriet Harman MP for the offences of driving without due care and attention and driving whilst using a hand-held mobile telephone in relation to an incident on 3 July 2009 in Peckham, London.
‘The Metropolitan Police Service provided papers to the CPS on 9 November 2009 which were reviewed by the Special Crime Division in accordance with the Code for Crown Prosecutors.’ Miss Harman was banned from driving for seven days and fined [pounds sterling]400 after admitting speeding at 99mph on the M4 near Swindon, Wiltshire, in January 2003.
She was also fined [pounds sterling]60 and given three penalty points for going 50mph in a temporary 40mph speed limit on the A14 near Ipswich in April 2007.
When she failed to pay the [pounds sterling]60 fixed penalty notice within a 28-day limit, she narrowly avoided being hauled back before court. But her summons to South East Suffolk Magistrates Court was withdrawn by prosecutors after she paid up at the 11th hour.
Yesterday a spokeswoman for Miss Harman, who lives in Herne Hill in South London but also has a house in Suffolk, said: ‘Miss Harman strongly refutes the allegations and will deny the charges.’ A spokesman for the road safety campaign Roadpeace said: ‘I cannot comment on this particular case

New Report Documents Bay Area-India Ties

SAN FRANCISCO — A new report by the Bay Area Council Economic Institute, Global Reach,
documents the deep connections between the economy of the San Francisco
Bay Area with India. More than two years in the making, and based on
nearly 200 interviews with business and community leaders, the study
assesses the unique ties linking the worlds innovation capital with its
fastest growing major economy after China.
Within the Bay Area, the report assesses the contributions of Indian
immigrants in building the regions economy, from the founding of many
of Silicon Valleys leading technology companies such as Sun, Brocade,
Cerent and Hotmail to the creation of venture capital firms that
continue to support entrepreneurs and technology start-ups. As a measure
of its success, the median income in the Bay Areas Indian community is
more than $107,000, 75% of adults have at least a bachelors degree, 70%
are in management or professional positions, and roughly half are
homeowners.
The report finds that the Bay Areas impact in India is also deep. Most
of the regions leading technology firms have R&D; centers or other
partnerships in India, and Bay Area venture capital firms have led the
investment charge into India. For example:

Visa has issued more than 30 million debit cards and 32 million credit
cards to Indian consumers; - India is Oracles fourth largest global market;

India hosts Symantecs largest engineering site outside the US, and

In recent years Indias technology economy has progressed from activity

software code, to a more sophisticated role where Indian IT companies
are taking on more complicated tasks such as systems integration and
end-to-end product development. Wage arbitrage (trading on high-volume
work and lower wage scales) is becoming less important, while more
complex, specialized work is increasing. According to Bay Area Council
Economic Institute President & CEO Sean Randolph, Many people still
think India is all about offshoring and low wages, but the reality has
changed dramatically. Indias growing capacity for high-end services,
research and product development is transforming it into a global
technology hub, and deepening the quality of its global partnerships. In

Another trend the report identifies is the emergence of a middle class

Credit Solutions ‘A Big Sigh of Relief,’ Says FL Client Who Got Out of Debt

DALLAS — In a new customer video success story, Aaron R. of Orlando, FL says
getting laid off from work and struggling with debt prompted him to
enter Credit Solutions debt settlement program. After going through the

The family of a man who investigated workers’ compensation claims will not receive benefits after his death in a car accident, the Missouri Court of Appeals has held.
Travis Anderson, who worked for Veracity Research Co., was out of town on a work assignment to survey a claimant suspected of fraud when he was killed.
Missouri cases generally hold that for workers’ compensation eligibility, employees are within the course of their employment continuously during a business trip and that injuries arising from eating out and sleeping in hotels are compensable.
The Western District, however, agreed with the lower court that Anderson had removed himself from the course of his employment at the time of the accident.
The decision also held that the employer’s untimely filing of its answer did not waive the issue of whether the employee’s death arose out of and in the course and scope of his employment.
The untimely answer did result in the admission of facts alleged in work accident claims the family’s claim for compensation.
Tools of the trade
Anderson, who lived in Wichita, Kan., was killed in a one-car accident in Jackson County in July 2003. His family filed a claim with the Division of Workers’ Compensation seeking benefits.
The location of the accident, which occurred around midnight, was near Anderson’s hotel and near the home of the claimant he was supposed to observe.
Anderson’s family argued that he was in the course of employment because he was required to be available to the company 24 hours a day, he was allowed to take a meal break while working and he was given a vehicle allowance.
But the employer presented evidence that Anderson was intoxicated at the time of the accident, was not authorized to work during the evening and did not have with him in the car the “tools of his trade.”
Police found these tools of the trade, which included a laptop computer, clipboard, camcorder and cell phone, in Anderson’s hotel room. A co-worker testified that Anderson could not perform his job without each of these items and that the company’s investigators were required to be accessible by cell phone at all times, even when on vacation.
“Substantial evidence presented here supported the determination that Anderson was not serving his employer’s interests at the time of the accident. Any inference of compensability arising from the mere fact that Anderson was out of town on his employer’s business at the time of the accident was effectively rebutted by the evidence,” concluded Judge James M. Smart Jr. for the court.
